A Fort Hood soldier was sentenced Wednesday to a month in jail for refusing to deploy to Afghanistan over his beliefs that the war violates international law.
Spc. Victor Agosto, 24, of Miami, pleaded guilty to disobeying lawful orders and was sentenced at the central Texas Army post. The judge also reduced his rank to the Army’s lowest level, a private, which also was part of the maximum penalty he faced in his plea agreement with the military.
Also, Agosto cannot be discharged at a level lower than other-than-honorable conditions, an administrative discharge. A discharge was not mentioned in the hearing, but Agosto is expected to be released from the Army after completing his jail term.
Oh the humaaaaanity! Get Amnesty International on the line! A month in the disciplinary barracks at Leavenworth and a reduced rank is the MAXIMUM he faces. Wow.
Seriously? We need protest marches through downtown Toronto in honor of these pussies? Either do your job, or face the consequences. That’s life, bitch.
Oh, and yet again, this guy joined AFTER the war had already started. Funny how that keeps happening.

Back when there was still a draft in the United States and every eligible male had to register on their 18th birthday, there were quite a number of members of the armed forces that didn’t want any part of military life. Now that it is an all volunteer armed forces, and an individual volunteers and signs a contract, that person is obligated to honor that contract whether they like it or not. It is not up to Spc. Victor Agosto to determine if the war in Afghanistan is a violation of international law or not. He must have been aware of the war prior to his enlisting, so he should follow through and do his job. I think Spc. Victor Agosto got of with a very light punishment. He should have been given IMNSHO a minimum of 6 months in the stockage. He should also get a Dishonorable Discharge, non of this light weight other than honorable conditions.
That is my opinion.

You’re confusing the draft with selective service registration. The draft ended in 1973, but even today all US males 18 to 26 are still required to register with the Selective Service (even though it’s not really enforced like it used to be). So technically, it’s been an “all volunteer” armed force for over 35 years.
BTW, there have been conscientious objectors well before the draft ended.

At the beginning of WW11 my grandfather was a conscientious objector. He went as a Padre while my uncle who was not, was a bombardier. There are all kinds of ways to let your feelings be known without breaking a contract. What a weasel that Victor Agosto is!
Actually, even if he had signed up before the war, I’d still say he deserves a tougher penalty. Nobody forced him to enlist — he willingly joined.
On my 18th birthday, I went to the post office in Paris, Illinois and filled out my Selective Service paper work. It’s the law, and I felt duty bound to do it – citizenship demands responsibility. This guy has a career going in the Army, he is a Specialist, does no one think that they may be deployed to a war zone if that is what the job description (inherent or otherwise) stipulates? It’s like being a firefighter and not wanting to hold the hose because an abortion clinic is burning.
